Board Meeting March 12, 2002

The regular Board Meeting of GCCHLA was held March 12 at 7 p.m. at the York Gulch Fire House. The following GCCHLA members were present:

Business Meeting

The Board Meeting was called to order by GCCHLA President Dave Gallaher.

Minutes were presented from the January 15, 2002 Board Meeting. The minutes were approved as published.

Treasurer, Larry Kramer, gave the treasurer's report:

There were no major expenses during this period.

Old Business

York Gulch Fire Department
Several people expressed continued concern about the status of the York Gulch Fire House, and the fact we were told not to hold meeting without permission. We are presently trying to determine what entity actually owns the Fire House - if it is owned by the Association or the Fire Authority.

There was also a discussion concerning the York Gulch Fire Fund. Since this money was raised by contributions from people who live or own property in the Gulch, it was strongly felt that the money must remain for use by the York Gulch Fire Department. Dave reminded everyone that the funds are controlled by the Board of the Homeowners Association, and not by the Fire Authority. Several people noted that the lights in the Firehouse seem to be left on at night. They wondered if lights are being left on for a reason, or by accident.

There was also a discussion of the problem of removal of equipment from the firehouse. Members felt strongly that whenever possible, equipment should be retained for the use of the York Gulch Department rather than distributed to other areas of the county.

Dave reminded everyone the Fire Department needs a simple floor plan from every homeowner to have on file at the firehouse. Especially important is the location of the batteries. In addition, show information about any external on/off switch you may have. Fire suppression is based on battery location. We want to have 100% compliance so your cooperation is appreciated. Web Site Update
Marci Bowman gave the report on the Association Web Site. She reported that due to problems with space on the server with the Scribble & Count site, the GCCHLA Website will be moved to http://boonieliving.com/GCCHLA. This is another company owner by Bill and Marci, and this site has more available server space. A link will be kept from the old URL.

Bill is still in the process of posting white papers on Solar Energy and Fire Mitigation. They are listed on the New @ page of the Website. Comments and suggestions are welcomed.
County Takeover of Association Roads
Dave reminded everyone that the county's bid to take over USFS roads is stalled due to Tim Allen's promotion, but is still lurking out there. We still don't know anything about the driveway permits, and are concerned about the status of those permits if the county takes over the roads. Dave explained if the roads are controlled by the county, homeowners whose driveways cross USFS land may have to pay their own permit fees.
Claim Access
Dave reported he has not talked to Damien and has nothing new on the claim access situation.
Phone Box in Roadway
Dave reported the phone box in the roadbed on York Gulch has been removed. YEA!
Forest Service Easement
Dave reported that he has been notified that the Forest Service is ready to move on York Gulch Phase I of the Small Tract Act. This sudden speed was quite unexpected. We still do not know the time frame.

A question was asked about who settled disputes when two homeowners want to purchase the same particle of land. Dave said he wasn't sure, he only knew that the Forest Service urges people to settle their differences before attempting to purchase the land.
Road Committee Report
Special Use District - Larry Kramer reported on the possibility of a Special Use District for road maintenance. He is working on determining the boundaries. Presently it looks as if the boundaries will go as far as the Octopus, and include the following roads:
York Gulch to the Octopus
Red Tail Ridge
Alpine
Chinook
Old Stage
Larry reported the following important details of a Special Use District:
  • Share the cost of road maintenance between more individuals.

  • In order to schedule an election, we will need signatures from 25% of benefitting property owners
  • .
  • The county will establish a proposed budget for annual maintenance.

  • A vote will be included with the 2002 General Election.

  • The petitions need to be signed by May 31.

There was a brief discussion of how such a district would redistribute the cost to more people, since currently it is the same people year after year who pay the road fee, and the same people who don't, but continue to drive on the roads.


New Business

Sheriff candidate presentation (Dave Wohlers)
Idaho Springs sheriff, Dave Wohlers is running for County Sheriff. He spoke briefly to the homeowners association, and then answered questions. He said he felt that the County Sheriff's office should place more emphasis on patrolling the unincorporated areas of the county, and less on taking over the duties of the State Patrol along I-70.

He said he feels that currently there is too much time being spent patrolling I-70 which is actually the job of the State Patrol. This is resulting in slow a response times when problems occur in other areas of the county.

He also said he felt the sheriff's department needs more citizen input, and would welcome input from groups such as homeowner associations.

He was asked if the current emphasis was primarily due to budget cuts to the State Patrol. He said he feels the State Patrol allots their budget according to how much or little they can expect from local law enforcement. He felt certain that if they had less help from Clear Creek Sheriff's Department, they would reallocate funds to cover the necessary patrol functions.
California Development
Dave reported that Al Mosche and a partner are considering the sale of claims located on a portion of the mountain located between Chinook Rd and I-70 to a California developer. The California developer is understood to specialize in homes in the million dollar range.

We believe the proposed development will be located closer to I-70 than to Chinook. Lower Fall River Homeowners Association is concerned about the possible impact to traffic on Fall River. It appears at this time that the impact will be greater to lower Fall River Road than to York Gulch.

Some of this land is owned by Mosche, and some is understood to be former BLM land now owned by the county. Existing zoning would have to be changed as well, because it is currently zoned for mining only.

There was a discussion about the pros and cons of such a development. The general feelings were:
  • Since probable access would be located on the I-70 frontage road or along lower Fall River, the traffic impact would probably be minimal.

  • The addition of high priced homes to the area would increase property values in York Gulch as well.

  • As long as zoning requires a fairly large lot size, in excess of ten acres, the overall impact to both York Gulch and Lower Fall River should be more positive than negative.
Batteries - Used AGM, sealed cell, UPS Deep Cycle $15
Dave reported he had found a source for used Deep Cycle batteries. They come from industrial battery backup units, and often have minimal actual use. Dave suggested that since the cost is so low, even if they only lasted a few years, the cost would be far less than buying new batteries.

Next Meeting

The next board meeting will be held Tuesday, May 21, at 7 p.m., at Jack Winkler's house at 210 Mule Deer Trail. Jack works for the airlines, so an alternate site will be announced if he will not be in town.
